McCarthy Decision handed down

18th June the Supreme Court handed down its decision in McCarthy v HRNSW and Appeals Tribunal regarding the Appeals Tribunal not awarding costs to McCarthy in the Mach Wiper case. http://hrnsw.com.au/hrnsw-media-release861.html

Lengthy reading, but I would daresay it can be summarised as McCarthy won, the Appeals Tribunal has to determine costs for the plaintiff according to law and HRNSW is to pay the amount set.

This case defied all the laws of gravity and no-one (except Luke and Belinda) thought it wouldn't succeed. I would have thought that when the case was dropped by HRNSW Luke would have been entitled to costs simply by the fact that he had no case to answer (through some weird changes that occurred in the samples). Was HRNSW just being bloody-minded when it came to reimbursing costs when there was an opportunity to do so?
