Mr Kaplan has pleaded guilty to a breach of Rule 240, in that his text message to Mr Nathan Jack on 25 January 2015 was improper.
A fine of $20,000 to be rendered within 21 days
That Mr Kaplan shall not participate as an owner of any registered standardbred in races for a period of 12 months effective 7 November 2016.

ACK!!! $20k?!? Especially considering the following:
Mr Kaplan’s contribution to the industry through various volunteer roles;
Mr Kaplan’s record as a considerable owner and breeder within the harness industry;
Mr Kaplan’s remorse for the conduct;
The nature of the offence, including the effect such conduct has upon the industry.
Stewards ordered the following penalty upon Mr Kaplan for his breach under Rule 240:
A fine of $20,000 to be rendered within 21 days
If he WASN'T a considerable owner and breeder, and didn't contribute to the industry, what would the fine have been?

20K may be relatively light, commensurate with the plotting/level of ill-gotten gains.
Could (should?) have:
a) had all ownership/breeding rights removed
b) Warned Off.

I have not read anywhere - what is supposed to have occurred? Is Harvey accused of asking Nathan Jack if they could have the lead?

PROMINENT owner Harvey Kaplan has been banned from owning standardbreds.
Following an investigation into his communications with Nathan Jack in the period leading up to the Goulburn meeting on January 26, 2015, Harness Racing New South Wales launched a lengthy investigation.
During that time, HRNSW conducted interviews, analysed betting relating to the race, as well as certain forensic imaging of mobile telephones and computers.
HRNSW was assisted by Harness Racing Victoria in this matter.
As such, Kaplan received several charges: Charge 1: Pursuant to Rule 187 (2), Charge 2: Pursuant to Rule 187 (3) and Charge 3: Pursuant to Rule 187 (6) for his failure to produce a computer to HRNSW when asked, although he did eventually heed the request.
Kaplan’s fourth charge was under Pursuant to Rule 240 – Improper Conduct relating to a text message sent to Jack on January 25, 2015.
Kaplan pleaded guilty to a breach of Rule 240, admitting his text message to Jack on January 25, 2015 was improper.
As such, Kaplan has been banned from ownership for 12 months and fined $20,000.
Kaplan has been involved in numerous Group One winners, including 2013 Miracle Mile star Baby Bling and millionaire Bling It On.
Jack has also numerous charges – Charge 1: Pursuant to Rule 240 – Improper Conduct relating to a text message received from Kaplan and his reply. Charge 2: Pursuant to Rule 246 – In that he has failed to report behaviour that could have cause or is likely to cause a breach of the rules. This charge is in the alternative to Charge 1.
The troubled horseman must show cause by the end of business tomorrow as to why HRNSW should not invoke Rule 183 pending the outcome of the investigation.

Offences
187. (1) A person who is directed to do so by the Stewards shall attend an inquiry or investigation convened or conducted by them.
(2) A person shall not refuse to answer questions or to produce a horse, document, substance or piece of equipment, or give false or misleading evidence or information at an inquiry or investigation.
(3) A person shall comply with an order or direction given by the Stewards.
(4) A person shall undergo any inspection, examination or test required by the Stewards.
(5) A person shall not abuse, intimidate or be deliberately obstructive of the Stewards.
(6) A person shall not frustrate or endeavour to frustrate an inquiry or investigation.
(7) A person who fails to comply with any provision of this rule is guilty of an offence.

Corruption and related matters
240. A person shall not, whether alone or in an association with others, do, permit or suffer anything before, during or after a race which in the opinion of the Stewards or Controlling Body:-
(a) may cause someone to be:-
(i) unlawfully advantaged, or
(ii) unlawfully disadvantaged, or
(iii) penalised.
(b) is corrupt.
(c) is improper.
As an ex pony trotter driver, that race brought back bad memories of what it was like to drive against fellow pony trotting drivers. Cannot even explain it

It would be interesting to know which part of Rule 240 was broken - If any inducement was offered to Jack then the 12 mths should have been 12 years

Bling It On trained by JP McCarthy because BJ McCarthy has been stood down and until recently part owned by Harvey (and still part owned by the father of a HRNSW Executive member - a little awkward in my book)
As you will see from this story, Adam owned or once owned a Bling but reports that the AJ that part owns Bling It On is his father

We have two Gp2's at Melton tonight won by
Cruz Bromac trained by the not so long ago suspended Michael Braun and partly owned by S Kaplan and until recently partly owned by Harvey
Bling It On trained by JP McCarthy because BJ McCarthy has been stood down and until recently part owned by Harvey (and still part owned by the father of a HRNSW Executive member - a little awkward in my book)
As you will see from this story, Adam owned or once owned a Bling but reports that the AJ that part owns Bling It On is his father

The trainer is Dean Braun, not Michael. There was a Michael Braun who played for West Coast Eagles hence the Ben Cousins reference.

I'd guess the content of the messages between the parties and how that content would stand up to legal scrutiny would have a significant bearing on what charges were laid, what penalties were handed down and any potential advancement of the "case" to Police for criminal investigation.
It's not a real flash look is it when a prominent owner of Group class horses and an equally prominent driver are caught up in something like this. It can make small fry like myself wonder about the foolishness of our endeavours.
I'm certain the parties feel like they've been punished......but what about the rest of us that feel like we are being short changed and are sick of seeing our game being further diminished by the actions of a few.
I reckon it's about time people who have been found guilty of multiple breaches of the integrity rules of this game are just plain rubbed out.
