No Kev I read it that he has not got off. These are the decisions of VCAT to uphold his appeal against being stood down from training and driving. This suspension was prior to the stewards completing their investigation and laying charges against Mr Demmler.
In essence the VCAT has ruled that cobalt cases are no different to any other and as stand downs prior to laying any charges are not applied across all illegal substance cases then they cant be applied to cobalt cases either. The judge says you cant penalise somebody when you are yet to charge him. There is no suggestion here that HRV stewards no longer intend to charge Demmler should they have sufficient evidence.
The RAD decision to uphold the stewards' decision to suspend was March.
The VCAT appeal decision against RAD was in May 2015 (articles above).
I guess there is more water to flow under this bridge since then.
Further to the above, charges were finally issued by stewards Sep 9 2015 and the case has yet to be heard by RAD.
